PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY GOVERN YOUR PURCHASE OF OUR SERVICES AND CONTAIN VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.THESE TERMS AND CONDITIONS ARE SUBJECT TO ARBITRATION.

  1. Acceptance of These Terms. You (“Customer”) may place orders for services with Oporto Special Rental Bikes via our website (www.oporto-specialrentalbikes.pt) or, in certain circumstances, over the phone. By placing an order for our services, you consent to these Terms and conditions (“Terms”) and acknowledge that we will only furnish the services subject to these Terms. Unless expressly agreed to in writing by Oporto Special Rental Bikes, any term or condition in any order or other form or correspondence that purports to add to or is in any way inconsistent with these Terms shall be inapplicable and of no force and effect whatsoever. Oporto Special Rental Bikes’s right to require strict observance and performance of each of these Terms shall not be affected by concurrent waiver of any other of these Terms or by any previous course of dealing.

  2. Rental terms and conditions. The bicycle rental service works with the following schedule: Monday through Saturday from 9h00 to 19h00. At the moment of renting a written contract will be signed where the personal data of both the Company and the costumer will be discriminated as well as the bicycle characteristics, time of rental and the term of responsibility. The contract must be signed by both parties and, in the case of underage children a legal guardian or someone on his behalf must sign the contract. Verification through identification card or passport is always required. The costumer must always make a careful use of the bicycle, in order to keep its good preservations, working order and safety. The costumer will not transport other people beside himself on the rental bike or loan it. The company reserves the right to refuse rental to: 1) Someone who doesn’t provide valid identification; 2) Someone who presents themselves under the visible influence of alcohol or other substances; 3) Someone who doesn’t offer the assurance of a prudent and careful use of the bicycle; 4) Someone who has previously violated or does not agree with the rental terms and conditions.

  3. Rental rates.The prices do not include the added value of tax applied at the time. Upon request of reservation the costumer is provided with a rental rate, this may be subject to adjustments and it the costumer decision to accept or not. In addition, depending on the details of reservation, the costumer may be requested to settle a security deposit during the rental time, which shall be returned at the end of the rental time but conditioned on a thorough check-up of the bicycle.

  4. Returns and Refunds. The costumer must return the rented bicycle at company’s shop as soon as the rental period expires, not doing so will require added charge. If the costumer returns the bicycles before the rental time ends he will not be reimbursed of any payment. Failing to return the rented bicycle will result in a criminal complaint of theft against the person responsible for the signing of this contract. In the events of the bicycle being stolen from the costumer he must immediately file a criminal report of said happening with the local authorites, being however responsible for the payment of the bicycle’s value marked MRSPP. The costumer will be accountable for any damage caused to the bicycle and its components, even in the events of an accident, and must indemnify the company of the costs it takes to repair said damages and of the time of repair required. The bicycle rental services do not imply a civil responsibilities or personal accident insurance from the company, making the costumer always responsible in any events. After completing the reservation of any booking of service, any cancellation or non appearance from the cliente, our policy is that the reservation is not refundable, with the exception of a prior notice of up to 30 days. 

  5. Malfunctions. In the events of any malfunctions with the equipment the costumer must immediately inform the company and return the bicycle to the shop. The remainder of the time will be discounted from the payment in case the issue is a clear malfunction of the bicycle and not its use. However, the time required for the problem to be fixed will be taken into consideration in that discounted value.

  6. Table of Collateral. In case of partial damages to the rented equipment the costumer will be subject to the following payments to the company (tax included) for current price MRSPP.   7. Reservation. Oporto Special Rental Bikes reserves the right to refuse to sell services to anyone for any reason, in its sole discretion.

  8. Entire Agreement. These Terms constitute the entire and only agreement between Oporto Special Rental Bikes and Customer, and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.

  9. Exclusivity. The parties’ rights, liabilities, responsibilities and remedies with respect to the Products shall be exclusively those expressly set forth in these Terms. The waivers, releases, limitations on liability and on remedies expressed in these Terms shall apply even in the event of the default, negligence, breach of contract, strict liability, of the party released or whose liability is limited and shall extend to their directors, officers, and employees.

  10. Omissions. In cases omitted from this regulation the law in force will regulate the parties.)
